By creating an account and using the Oscillation Design platform ("Service"), operated by Oscillation Design LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Intellectual Property Rights (Your Content)
You retain full ownership and all intellectual property rights to the CAD/STEP files and any other design data you upload to the Service ("User Content"). We understand the sensitivity of your proprietary designs and treat all User Content as strictly confidential.
To perform our analysis, you grant Oscillation Design a limited, non-exclusive, worldwide, royalty-free license to access, process, and display your User Content solely for the purpose of providing the DFM analysis service to you. This license terminates immediately upon your deletion of the file or your account from our Service. We will never use your User Content to train machine learning models, share it with other users, or use it for any purpose beyond providing the Service to you.
2. Service Description and Disclaimer of Warranties
The DFM feedback, suggestions, and analysis provided by our Service are for informational and advisory purposes only. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Oscillation Design does not guarantee the manufacturability, functionality, or success of any part based on the feedback provided. The analysis is not a substitute for professional engineering judgment, and the User is ultimately and solely responsible for verifying their design and ensuring its fitness for purpose. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
3. Limitation of Liability
IN NO EVENT SHALL OSCILLATION DESIGN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (including, without limitation, damages for loss of profits, data, goodwill, or business interruption) arising out of the use or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the Service during the twelve (12) months prior to the initial action giving rise to liability. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
4. Indemnification
You agree to indemnify, defend, and hold harmless Oscillation Design and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any claim that your User Content caused damage to a third party.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or algorithms of the Service.
- Scrape, crawl, or use automated means to access the Service or extract data from it.
- Interfere with or disrupt the integrity or performance of the Service or its related systems.
- Attempt to gain unauthorized access to the Service, other user accounts, or related computer systems or networks.
- Upload files containing malicious code, viruses, or any other harmful components.
- Resell, sublicense, or redistribute the Service or any analysis results to third parties without our prior written consent.
6. Subscriptions and Payment
Our Service is billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Subscriptions are automatically renewed at the end of each billing cycle unless canceled by you through your account dashboard at least 24 hours before the end of the current billing period.
All payment processing is handled by our third-party payment processor, Stripe. By providing payment information, you agree to Stripe's terms of service. You are responsible for providing accurate and complete billing information. We reserve the right to change subscription pricing upon 30 days' written notice. Price changes will take effect at the start of your next billing cycle.
Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us at support@oscillation.design within 14 days of the charge.
7. Account Termination
You may cancel your account at any time through your account dashboard or by contacting us at support@oscillation.design. Upon cancellation, your access to the Service will continue until the end of your current billing period.
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if: (a) you breach any provision of these Terms; (b) your use of the Service poses a security risk to us or any third party; (c) your use of the Service may subject us to liability; or (d) your account has been inactive for an extended period.
Upon termination, your right to use the Service will immediately cease. We will retain your User Content for 30 days following termination, after which it will be permanently deleted. You may request an export of your data prior to termination.
8. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Houston, Texas.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and cancel your account.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Harris County, Texas.
11. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oscillation Design regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Oscillation Design LLC ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform ("Service"). Please read this policy carefully. - Account Information: Your email address, shop name, and account credentials to create and manage your account.
- Uploaded Design Files: The CAD/STEP files and geometric data you upload. This data is treated as strictly confidential and is used solely to provide the DFM analysis you have requested.
- Payment Information: We do not directly collect or store your credit card or bank account information. All payment processing is handled exclusively by our third-party payment processor, Stripe, Inc. Stripe may collect and store your payment information in accordance with their own privacy policy.
- Usage Data: We automatically collect technical data including your IP address, browser type and version, operating system, referring URLs, pages visited, time and date of visits, and other diagnostic data to monitor and improve our Service.
- Device Information: Information about the device you use to access the Service, including hardware model, operating system, and unique device identifiers.
2. How We Use Your Information
We use the information we collect for the following purposes:
- To provide, operate, and maintain the Service, including performing DFM analysis on your uploaded files.
- To process your subscription payments and manage your account.
- To communicate with you, including sending transactional emails (invoices, password resets, account notifications).
- To monitor and analyze usage trends to improve the Service's performance and user experience.
- To detect, prevent, and address technical issues and security threats.
- To comply with legal obligations and enforce our Terms of Service.
We will never use your uploaded design files to train machine learning or AI models, share them with other users, or use them for any purpose beyond providing the DFM analysis Service to you. Your intellectual property remains exclusively yours.
3. Cookies and Tracking Technologies
We use cookies and similar tracking technologies to enhance your experience on our Service. These include:
- Essential Cookies: Required for the Service to function properly, including authentication and session management.
- Analytics Cookies: Used to understand how visitors interact with the Service, helping us improve functionality and user experience.
You can control cookie preferences through your browser settings. Disabling essential cookies may affect the functionality of the Service.
4. Data Sharing and Third-Party Services
We only share data with essential third-party services required to operate our platform:
- Stripe, Inc. — for payment processing
- SendGrid (Twilio) — for transactional emails
- Cloud Hosting Provider — for data storage and computing infrastructure
These third-party providers are contractually obligated to protect your data and may only use it to perform services on our behalf. We do not sell, rent, or trade your personal information to any third parties.

6. Data Retention
We retain your information for as long as your account is active or as needed to provide the Service. Specifically:
- Account Information: Retained for the duration of your account and deleted within 30 days of account closure.
- Uploaded Design Files: Retained for the duration of your account. You may delete individual files at any time through the Service. Upon account termination, all uploaded files are permanently deleted within 30 days.
- Analysis Results: Retained for the duration of your account and deleted along with your uploaded files.
- Usage Data: Retained in anonymized, aggregated form for up to 24 months for analytics purposes.
- Payment Records: Retained as required by applicable tax and accounting laws (typically 7 years).
7. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: You may request a copy of the personal data we hold about you.
- Correction: You may request that we correct any inaccurate or incomplete personal data.
- Deletion: You may request that we delete your personal data, subject to certain legal exceptions.
- Export: You may request a machine-readable export of your data.

10. Children's Privacy
Our Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly.
